That is the question.

I declared on a enemy and his fed mate Auto dec'd on me with 2 countries. The war starts in a couple of hours and the dood who auto dec'd has NO Nuke defence set up. :(
Should I Nuke the innocent in the hope I've preempted the guilty?
Or should I not Nuke the guilty in the hope that they are innocent?

Guilty of what? Auto declarations! Nuke your enemy and work to get his allies (fed mates) to abandon him.

That's like shooting an unarmed man. However to be unsecured, be in a fed and to set auto-dec means to me he should have armed himself.

You are uncertain they will attack you, so nuke them only when they attack you.

Now that I think about it... This thing happened to us, and I only attacked you, because you nuked me.
